In the early hours of October 31st, 1993, the rapper and his entourage were returning to the Sheraton Colony Square hotel after a performance at Clark Atlanta University when they saw two drunk men assaulting a black motorist at this intersection in Midtown.
When Shakur noticed the fight, he decided to intervene.
Although there are varying details about what happened, the most accepted story is that one of the drunk men brandished a gun and aimed it at the rapper. In response, Shakur pulled out his own pistol.
During the brief standoff, one of the men smashed the front window of Shakur's vehicle with the butt of his gun. Witness reports also suggest that one of the men may have fired a shot.
The incident came to a head when the rapper reportedly got down on one knee and fired three shots.
One of the men was struck in the abdomen, while the other received a bullet wound to his buttocks.
Following the shooting, it was revealed that the men in question were Mark and Scott Whitwell—two brothers who worked as cops in neighboring counties.
That evening, the off-duty police officers had been celebrating at the Sheraton Colony Square hotel with their wives, as Scott's wife had recently passed the bar exam. However, things quickly turned sour when a passing motorist nearly hit them while they were crossing the road.
This near-miss led to a verbal altercation, which turned violent after the Whitwell brothers allegedly attacked the motorist.
As the confrontation was unfolding, a traffic jam began to form outside the hotel.
Moments later, Shakur and his entourage arrived at the intersection and began to wonder what was causing the delay. After investigating the holdup, the rapper saw the two officers "jumping" the motorist and decided to rush to his defense.
Although Shakur was arrested and charged with two counts of aggravated assault, the charges were later dropped after it came to light that the Whitwell brothers were drunk and carrying guns that had been stolen from a police evidence locker.
Furthermore, when investigators spoke to witnesses at the scene, they learned that Mark and Scott Whitwell had lied when they said that the rapper attacked them for no reason.
Consequently, the authorities decided that Shakur had acted in self-defense.
In the end, all charges were dropped against both parties.
Six months after the shooting, Mark Whitwell retired from the Clayton County Police Department.
In 1994, his brother Scott Whitwell filed a civil suit against the rapper, citing mental suffering, ongoing medical costs, and physical pain. In response, Shakur filed a countersuit on the basis that Scott had allegedly lied about the incident.
However, Shakur was killed during a drive-by shooting in Las Vegas before the case was settled.
Two years after the rapper's death, a judge was forced to issue a default judgment of $2 million against his estate after his lawyer failed to appear in court with the relevant disclosures.
